Why Every Coloradan Should Care About a New Real Estate Law
A new law in Colorado could have far-reaching consequences—not just for REALTORS®, but for anyone looking to buy or sell a home. While it may seem like just another regulation, this bill, passed last year, could make home showings riskier for real estate professionals and, ultimately, impact the homebuying experience for everyone.
The Issue at Hand
At the heart of the controversy is identity verification. REALTORS® often use tools like Forewarn to screen potential buyers before meeting them in person—a crucial safety step, especially when showing vacant properties alone. But unless lawmakers address this issue before May, any REALTOR® who chooses to verify an individual’s identity before a showing could face legal trouble.
Why? The law could classify turning someone away due to lack of verification as an unfair or deceptive trade practice. That means a REALTOR® trying to protect themselves could be accused of discrimination and face penalties. By 2026, these violations could even result in lawsuits—without protection from standard insurance policies.

If you’re thinking, “I’m not a REALTOR®, why should I care?”—consider this:
· Safer Showings Benefit Everyone – Identity verification helps ensure that real estate transactions are safe for both REALTORS® and home sellers. If safety measures are removed, REALTORS® may be forced to meet strangers in empty houses without any vetting.
· Home Sales Could Slow Down – If REALTORS® hesitate to show homes to new clients due to legal risks, the homebuying process could become less efficient and more stressful for buyers and sellers alike.
· Legal Risks Could Drive Up Costs – If lawsuits become common in real estate transactions, legal fees and insurance costs could rise, making home sales more expensive in the long run.
What Needs to Happen
With a deadline looming in May, Colorado lawmakers must revise the law to balance fair housing protections with the safety of real estate professionals. There’s no reason why REALTORS® should have to choose between protecting themselves and complying with the law.
