Caveat Emptor – Buyer Beware!
Imagine you are ready to make one of the largest decisions of your life. Hundreds of thousands of dollars are at stake as you step into one of the most complex processes you may ever go through. And… you’re on your own. Buyer Beware!
No one to help you out, guide you, coach you…. Just you and a ton of conflicting “advice” on the internet AND no one to convert all that information into wisdom so you make the right choices.
Spooky Story or Reality?
Sound like a spooky Halloween story? Worse it was reality for thousands of home buyers before the National Association of Realtors and the Multiple Listing Services came about. Back then the use of caveat emptor, Latin for buyer beware, was common to warn buyers away from those slick salespeople representing the interests of home sellers.
Even worse, you had to work together with the salespeople who had the listing. So if you wanted to look at multiple available homes, you may have to work with multiple different people, who were hired to represent the interests of the seller. Caveat emptor!!
Buyer’s Agents Today
It is easy to take for granted the ease today of selecting the best agent to help you with your home purchase and know they have your interests first (if they belong to the National Association of Realtors). And you know that you will not only have access to the homes that brokerage lists, but all homes listed in the area on the multiple listing service. Your buyer agent is probably even trying to find additional homes not even on the market for you.
Oh, and even though you might be obliged to pay your agent for these great services, they can usually seek their compensation elsewhere. Often the listing agent is willing to share their commission to help find good buyers for their client. This is a great system helping keep the cost of purchasing low for buyers while promoting cooperation and competition in the industry.


BUT – Buyer Beware!
There is increasing pressure to redesign this system and push buyers back to the days of yore. You only need to look at the continual flow of lawsuits trying to disrupt this system. The National Association of Realtors has stood its ground time and time again, helping protect consumers and small businesses alike against these forces.
NAR spokesperson Mantill Williams outlined it best when responding to Inman news source
“Pro-competitive, pro-consumer local MLS broker marketplaces ensure equity, efficiency, transparency and market-driven pricing options for home buyers and sellers. The practice of the listing broker paying the buyer broker’s compensation saves sellers time and money by having so many buyer brokers participating in that local marketplace and thus creates a larger pool of buyers for sellers.”
“For buyers, these marketplaces save them the burden of extra costs at closing, enable them to receive professional representation and make homeownership possible for more people. In fact, the U.S. model of independent, local broker marketplaces is widely considered the best value and most efficient model in the world, with no hidden or extra costs and with more complete, verified information compared to other countries. We look forward to arguing our case in court.”
Corporate America vs The American Dream
One only needs to look at who would gain the most by disrupting a system that is designed to protect the public, encourage home ownership, maintain strong small businesses, boost cooperation and competition. We can only hope organizations like the National Association of Realtors can hold off the tide of corporate America trying to pull profits at the public’s expense.
Let’s hope we don’t again see a time when it becomes a nightmare for homebuyers to obtain the American dream and these stories stay ghost stories for the campfire.
