What Does a Title Company Actually Do? A Simple Guide to Colorado Deeds

Why Title Companies Matter in a Real Estate Transaction

Title companies provide a critical service in any real estate transaction but it seems like so few people know what they do or their importance. There are many great title companies out there that our team regularly works with and can recommend to you in a real estate transaction. There are five principal types of deeds in Colorado.

The Five Principal Types of Deeds in Colorado

The five principal types are Special Warranty Deed, General Warranty Deed, Bargain & Sale Deed, Quit Claim Deed, and a Personal Representative Deed. With the help and credit to our good friends at Chicago Title of Colorado, we will break down the three most common ones: Special Warranty Deed, General Warranty Deed, and Quit Claim Deed.

Special Warranty Deed: Protection Limited to the Seller’s Ownership

Special Warranty Deed: "In a Special Warrant Deed the seller says, in effect, to the buyer 'I only warrant (guarantee) that I have done nothing to make the title bad or defective or encumbered while I have owned it; that I have good, right and lawful authority to sign and deliver this deed; that the title which this deed conveys is good and is clear insofar as my actions are concerned'".

General Warranty Deed: The Broadest Seller Warranty

General Warranty Deed: "In a Warranty Deed, the seller who signs the deed says, in effect, to the buyer, 'I warrant that I have good title to the land, that there are not material defects in my title and no outstanding interests held by third parties; that there are no mortgages, unpaid taxes or other liens or encumbrances outstanding on the land; that I have good, right and lawful authority to sign and delivery this deed; and that this deed conveys to the purchaser good, indefeasible title to the land.'"

Quit Claim Deed: Transferring Whatever Interest Exists

Quit Claim Deed: In a Quit Claim Deed there are no warranties or representations or even an implication that the grantor owns or holds title to the land or to any particular interest in it. In such a deed the grantor simply states to the grantee, 'I surrender to you and quit claim and abandon all claims and interest, if any, which I may have in the land described herein.' While Quite Claim Deeds are seldom used to convey titles, in most such deeds, like Bargain and Sale Deeds, will pass title to the grantee if the grantor owns the land.

Need a Copy of Your Deed? Ask Before You Pay for It

Having a knowledgeable and personable title representative is invaluable. Our team has worked hard over the years to build a trusted and experienced team of professionals all working for you. Our goal is to make your transaction as smooth as possible.
If you have any questions about title work or information regarding a deed, don't hesitate to reach out. And please, don't pay some company a ridiculous amount of money to get you a copy of your deed. We can typically get that for a much lower cost (if not possibly free).
